D.C. Court Rejects White House’s Rulemaking Power Regarding NEPA
The U.S. Court of Appeals for the District of Columbia Circuit has ruled that the White House Council on Environmental Quality violated the separation of powers by instructing agencies on how to comply with the National Environmental Policy Act (NEPA).

“NEPA has been weaponized by environmental activists to kill commonsense and needed energy infrastructure projects. The D.C. Circuit’s ruling is a step in the right direction, and will help provide regulatory certainty to large-scale, capital-intensive projects that will help create jobs, strengthen our economy, and power our nation and our allies.”
